Terms and Conditions of Use for Kerruay Platform Welcome to Kerruay (hereinafter referred to as the "Platform"), operated by LOGA group co.,ltd. Please read these terms carefully before using the Platform. By accessing or registering, you agree to all terms herein. 1. Definitions "Streamer" means a content creator or recipient of support who registers and opens an account with the Platform. "Supporter" means a user who gives tips to streamers through the Platform. "Tip" means money that a supporter voluntarily gives to a streamer through the Platform. "Alert" means the on-stream notification display feature that is bundled with a tip at no separate charge. "Payment Service Provider" means the licensed third-party payment processor that the Platform engages to process payments and settlements. 2. Platform Status The Platform is solely a "technology intermediary" providing messaging, alert display, and payment connection services. The Platform is not a foundation, association, or charitable organization, and is not a direct party to any transaction between supporters and streamers. The Platform acts as an intermediary at all times and never becomes the seller of goods or services exchanged between users. 3. Nature of Transactions Not Charitable Donation: Money sent by supporters to streamers through this Platform is a tip given directly to the streamer. It is not a charitable donation and cannot be used for tax deduction. Voluntary and Final: All tips are given voluntarily and are final and non-refundable. 4. Payment Processing All payments are processed by a third-party Payment Service Provider engaged by the Platform. Streamers must connect and maintain an account with the Payment Service Provider to receive payouts. The Platform may change its Payment Service Provider at its discretion; in such case these terms remain in effect and only the fee figures stated in clause 7.2 will be updated, with notice given under clause 7.2. 5. Accounts and Registration Users must provide accurate information and complete identity verification (KYC) as required by the Payment Service Provider and applicable law. Users are responsible for all activity under their accounts. 6. Terms for Supporters 6.1 Tips and Alerts: A supporter gives a tip directly to the streamer of their choice. The alert is a display feature bundled with the tip free of charge; it is not priced or sold separately. The Platform does not sell alerts, and a tip is not payment for any goods or services sold by the Platform. 6.2 Finality: By giving a tip, you agree that all tips are final and non-refundable. 6.3 Content: Supporters must not send messages, images, links, or any content that violates clause 9. 7. Terms for Streamers 7.1 Receiving Tips: The streamer is the sole recipient of tips given through the Platform. Funds are settled to the streamer's account with the Payment Service Provider, and payouts follow the Payment Service Provider's schedule. 7.2 Fees: The Platform charges a service fee (Platform Fee) of 1% of the transaction amount. In addition, the Payment Service Provider charges payment processing fees (to be determined) for PromptPay and credit/debit cards. These fees are deducted before funds are settled to the streamer. If the Platform adjusts any fee rate, streamers will be notified at least 15 days in advance via the website or email (in accordance with ETDA DPS guidelines). 7.3 Rewards: If the streamer offers any goods, services, or rewards in return for tips, the streamer is the seller of those items and is solely responsible for them, as set out in clause 10. 8. Refund Policy Since tips are transferred to the streamer's account immediately upon a successful transaction, the Platform has a No Refund policy in all cases. If a transfer error occurs or a supporter wishes to request a refund, the supporter must contact and settle directly with the streamer who received the funds. The Platform is not responsible for any losses or disputes arising therefrom. 9. Content Prohibitions and Limitation of Liability Users (both streamers and supporters) are prohibited from sending messages, images, links, or any content that violates the law, is obscene, defamatory, incites hatred, or infringes on others' intellectual property rights. If violations are found, the Platform reserves the right to suspend service to the account immediately without prior notice, and the Platform shall not be liable for any damages arising from user content (under the Computer Crimes Act). 10. Rewards Offered by Streamers If a streamer offers goods, services, or other rewards in return for tips, the streamer alone is the seller and provider of such items. The Platform is not a party to that arrangement and bears no responsibility for quality, delivery, consumer protection claims, taxes (including VAT), or any dispute between the streamer and supporters regarding such rewards. 11. Amendments and Termination The Platform may amend these terms from time to time and will notify users of material changes via the website or email. Continued use after the effective date constitutes acceptance. The Platform may suspend or terminate accounts that breach these terms. 12.
